Terms and Condition
All our dessert(s) made by T. Marie Bakes and are subject to the following Terms and Conditions. When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.
The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your payment method.
Ingredients
All dessert(s) may contain or come into contact with, soy, dairy, egg, wheat, nuts and other allergens.
It is the responsibility of the Customer to inform us prior to the confirmation of their order of any allergy issues. It is the responsibility of the Customer to inform their guests of all allergy information and accordingly, we will not be held liable for any allergic reaction resulting from consumption of the desserts(s).
Quotations
All Quotations are valid up to the fourteen (14) day order deadline, prior to your pick-up/delivery date.
Orders
We need a minimum Seven (7) day notice for all custom orders, as we are continuing to grow and fill our calendar. We need a minimum three (3) day notice for all standard and personalized orders placed through the Shop on the website. If you need a rush order on custom cakes, there will be an additional fee, and order is subject to availability
Any dessert(s) ordered from a picture or photo of a product produced by any other baker, can only be reproduced by us as our interpretation of that product, and will NOT be an exact reproduction of the product in the picture or photo.
Unforeseen Circumstances
If we cancel the booking due to illness or any other unforeseen circumstance that affects the ability to deliver or pick-up the ordered dessert(s), the payment will be fully refunded within seven (7) days of notification to the Customer.
Final Balance Payments and Pick-ups/Delivery
The payment is due seven(7) days prior to pick-up/delivery date. We only accept online payments through our website.
It is the responsibility of the Customer to check the state of the dessert(s) before leaving the premises. Once the item has left the premises, the Customer is responsible to ensure that the dessert(s) gets to its destination safely and is stored as per our instructions to achieve best results for taste and quality.
Pick Up
The Customer is liable for any damage, accident, or mishap that may occur once the dessert(s) is released from the care and custody of the Baker, regardless of who picks up the dessert(s). The Baker is not liable for any damage that may occur thereafter.
Delivery
We offer delivery for certain destinations. Delivery is charged at our discretion.
Delivery will be carried out in a safe and appropriate manner. Once delivered to the customer and change of hands has been completed with the dessert(s) in appropriate condition, it is then up to the customer to store and care for the cake/dessert(s) as per our instructions. If anything is to happen to the cake/dessert(s) after this exchange, we are not liable for any damages.
A delivery date and time will be agreed by both parties, and if the customer is not at location at this time and date, and we are not able to contact the customer, the product will be transported back to our premises and it will be the customer’s responsibility to collect the dessert(s).
Publication
We reserve the right to use any image of a Product made by us for publication at a later date.

These products are homemade and not subject to state inspection.
Refunds/Cancelation/Postponement Policy
Postponement
If, for any reason the event is required to be postponed, please contact us immediately.
The new order date proposed will be subject to availability.
Cancellations/Refunds
If cancellation of the order is required, and you have paid your full balance, the refund policy is as follows:
If the cancellation is one (1) week or more prior to your pick-up/delivery date, you will receive a full refund, less the cost of any supplies already purchased for your dessert(s).
If the cancellation is less than seven (7) days prior to your pick-up/delivery, there will be absolutely no refunds given.
Refunds will be paid within 30 days of cancellation.
